The Bayfront Tower, one of Florida’s most prestigious condominium buildings, is a 29-story high rise located on Tampa Bay in downtown St. Petersburg, FL. While undergoing routine repair the staff found decay in exterior wall studs. The Board of Directors upon recommendation of their legal counsel retained Tutwiler and Associates to advise and assist them with their insurance claim for collapse coverage. Ultimately, the matter was litigated due to the carrier denying the claim. A verdict was reached in Bayfront’s behalf in July 2010 in the amount of $1.8 million. We are pleased the court affirmed our original opinion to the Board that this loss arose to the level of a collapse based on the facts and the insurance policy coverage that was in place at the time of the discovery of this loss.
